El pasado julio el Pleno del Parlamento Europeo consiguió aplazar la propuesta de Directiva sobre Copyright realizada por la Comisión de Asuntos Jurídicos. El próximo 12 de septiembre se procederá a una nueva votación ante la que la industria de internet en total unanimidad se han posicionado para rechazar dicha propuesta.
Representantes de la industria como Pedro Mier, presidente de AMETIC; Carina Szpilka, presidenta de ADIGITAL; José Luis Colás Giraldos, presidente de iCmedia; José Carrero García, presidente de ASGECO Confederación; Carlos Mateo, presidente de la Asociación Española de Startups; y Víctor Domingo, presidente de la Asociación de Internautas, se han unido para rechazar dicha propuesta de la Directiva Europea de Copyright realizada por la Comisión de Asuntos Jurídicos del Parlamento Europeo y manifestar su sorpresa y decepción ante la postura del Gobierno sobre ésta.
Entre otros aspectos destacan que es «particularmente preocupante que no se ha contado con la opinión de los demás interesados, representantes de la industria tecnológica, usuarios, consumidores, internautas y startups».
Pese a que en la votación del pasado julio la propuesta salió rechazada, el próximo 12 de septiembre se volverá a realizar dicha votación ante la que el Gobierno ha solicitado a los eurodiputados españoles que apoyen la redacción de la actual propuesta en la votación del próximo 12 de septiembre, sin que los sectores afectados hayan tenido la oportunidad de explicar los motivos por los que no la consideran la más adecuada.
La industria se manifiesta
Este colectivo solicita al Gobierno que reconsidere su postura, al entender que la propuesta de directiva incluye medidas que podrían ser altamente perjudiciales para el desarrollo de Internet, afectando negativamente tanto al desarrollo de los negocios en este ámbito, como al acceso a los contenidos por parte de los consumidores. Es fundamental obtener un equilibrio entre los derechos de los interesados sin perjudicar el ejercicio de otros derechos como el de libertad de expresión.

La redacción actual de la propuesta supone una obligación de filtrado convirtiendo a los proveedores en “policías” de la web, debiendo monitorizar y filtrar activamente los contenidos compartidos por usuarios, con fuertes obligaciones para la detección y eliminación de contenidos que puedan estar protegidos por derechos de autor, al reinterpretar el concepto de comunicación pública y hacer responsable al proveedor.
Es una medida que perjudica seriamente la libertad de expresión en Internet, limita el derecho de acceso a la información y afecta directamente a la privacidad e intimidad, entre otras cuestiones.
Convierte a las empresas proveedoras en jueces de las posibles infracciones, al mismo tiempo que presupone que los usuarios vulneran los derechos de propiedad intelectual.
Supone un riesgo de fragmentación en la transposición de la Directiva en cada país, lo que minaría el Mercado Único Digital que se pretende.
Establecería un cambio radical en la regulación, frente a la seguridad jurídica que ha aportado durante más de una década la Directiva de Comercio Electrónico, trasladando la responsabilidad del contenido a la plataforma, mero proveedor del servicio de alojamiento de contenidos.
Las organicaciones solicitan al Gobierno por un lado, que reconsidere la postura trasladada y que explore medidas de auto y co-regulación y a los eurodiputados españoles que busquen un equilibrio entre los derechos de autor y los derechos de los ciudadanos y de las empresas innovadoras.
Tras la votación de rechazo, Víctor Domingo habló con ComputerWorld, explicando que
dicho resultado de la votación había sido «una victoria de la transparencia». No obstante aún hay mucho que avanzar, y el siguiente paso será el próximo dia 12.
