Así lo ha asegurado la vicepresidenta de la Comisión Europea, Margrethe Vestager, en el marco de la aprobación de la Ley de Mercados Digitales (DMA) prevista para la próxima primavera.
La vicepresidenta de la Comisión Europea, Margrethe Vestager, ha presentado ante el CIE las nuevas reglas del tablero europeo en materia de transición digital. Una comparecencia en la que ha abogado por la “cooperación transfronteriza” tras radiografiar la “naturaleza global y sistémica de las prácticas y las características del mercado que hemos visto en las plataformas digitales”. En este contexto daba alas a la reforma emblemática de la Unión Europea para abordar el poder de la plataforma Big Tech: la Ley de Mercados Digitales (DMA). Esta, según las palabras de la mandataria danesa, entrará en vigor a principios del 2023. “La DMA entrará en vigor la próxima primavera; nos estamos preparando para su aplicación tan pronto como lleguen las primeras notificaciones”, ha asegurado Vestager desde Estrasburgo.
El próximo capítulo que comienza a escribir Europa “es emocionante”. A pesar de requerir muchos preparativos concretos, la nueva regulación “trata de establecer nuevas estructuras dentro de la Comisión, poniendo en común los recursos de la Dirección General de Competencia y la Dirección General de Comunicaciones basados en la experiencia relevante”, ha incidido. “Se trata de contratar personal. Se trata de preparar los sistemas de TI. Se trata de redactar más textos legales sobre procedimientos o formularios de notificación. Nuestros equipos están actualmente ocupados con todos estos preparativos y nuestro objetivo es presentar las nuevas estructuras muy pronto”, proseguía.
La arquitectura de la DMA está diseñada en torno a la aplicación central a escala europea, con guardianes designados sujetos a lo que se debe y no se debe hacer. En este sentido, se pretende poner coto a las Big Tech: “No hace falta decir que cuanto más podamos, como comunidad de competencia internacional, armonizar nuestro enfoque, menos oportunidades habrá para que los gigantes tecnológicos globales aprovechen las brechas de cumplimiento entre nuestras jurisdicciones”.
Sin embargo, la preocupación ante el riesgo de que la Comisión no esté lista de inmediato para el nuevo rol centralizado del ‘alguacil’ de Big Tech de la DMA, es patente. Un rol que consistirá en evaluar si los gigantes de la plataforma se apegan a los requisitos ex ante, la larga lista de reglamentaciones que cubren obligaciones de cumplimiento detalladas relacionadas con cuestiones como la autopreferencia, los términos FRAND, la interoperabilidad y la portabilidad, entre otras. La Comisión también será responsable de tomar medidas de ejecución efectivas para poner rápidamente en línea a cualquier controlador que infrinja las obligaciones.
Los gigantes tecnológicos que estarán sujetos a la DMA aún no han sido designados. No obstante, los criterios de “un servicio de plataforma central” con un impacto “significativo” en el mercado interior de la UE; una capitalización de mercado de al menos 75.000 millones de euros; al menos 45 millones de usuarios finales mensuales en la UE y más de 10.000 usuarios comerciales anuales, así como una posición de mercado arraigada, significa que los gigantes habituales de GAFAM están ciertamente en el marco.
El plazo ligeramente más largo de lo esperado para la entrada en vigor de la DMA garantiza a la Unión Europea más tiempo para prepararse adecuadamente a las exigencias de la nueva normativa. Sin embargo, más tiempo de preparación implica, inevitablemente, una pista más larga antes de que sea posible cualquier aplicación, lo que puede redirigir críticas a la Comisión, ya que cualquier retraso en atajar las infracciones de las Big Tech reforzará a los detractores. Garantizar que los mercados digitales permanezcan abiertos y disputables rápidamente es esencial.
