En octubre entrará en vigor la normativa que, tras numerosos procesos sancionadores contra estas compañías, pretende abrir la competencia digital a un número mayor de jugadores.
La Ley de Mercados Digitales (DMA, de sus siglas inglesas) europea es ya una realidad –será de obligado cumplimiento en octubre– y podría limitar mucho la actividad de los llamados GAFAM (Google, Amazon, Facebook –ahora Meta–, Apple y Microsoft) e incluso cambiar sus modelos de negocio ya que frenará su control sobre los datos de los ciudadanos europeos, establecerá marcos de competencias para evitar los monopolios y diseñará normas de acceso a sus plataformas. Estas empresas, conocidas en la jerga popular como guardianes en línea, tendrán que hacer que sus servicios de mensajería sean interoperables y proporcionar a los usuarios empresariales acceso a su información para que estos puedan promocionar productos y servicios de la competencia en sus propias plataformas.
“Los gigantes corporativos han impedido que las compañías y los usuarios se beneficien de un sistema de mercado digital competitivo”, ha señalado Margrethe Vestager, comisaria europea de competencia, sobre una norma que se ha aprobado en tiempo récord, ya que se empezó a debatir el pasado 24 de marzo, aunque se presentó hace más de un año, y que a día de hoy ya tiene consenso. “Esto significa que los largos casos antimonopolio, en los cuales las autoridades europeas iban por detrás de las tecnológicas, han llegado a su fin”. Uno de los grandes centros de debate del documento ha sido tratar de evitar que estas compañías favorezcan sus propios servicios sobre los de sus rivales en los distintas sistemas operativos y llegar a acuerdos para que los ciudadanos puedan eliminar las aplicaciones preinstaladas.
.En cualquier caso, la DMA solo afectaría a estas grandes multinacionales ya que solo se aplicará a organizaciones cuya capitalización bursátil supere los 75.000 millones de euros, obtengan al menos 7.500 millones de facturación anual y tengan 45 millones de usuarios mensuales. Las multas por incumplimiento serán de hasta un 10% de su facturación global anual y podrían llegar al 20% en caso de reincidencia.
Para explicar la idiosincrasia de la ley, Vestager ha apelado a la cuantía de casos abiertos, a lo largo de los años, contra estas empresas. “Hemos aprendido que se pueden corregir casos puntuales y sancionar comportamientos ilegales, pero cuando las cosas se vuelven sistémicas, necesitamos que entre la regulación”. Además, se ha congratulado por el hecho de que sea la propia Unión Europea (UE) la que “marca las reglas del juego”. “Esto es similar a lo que ocurre en muchos otros sectores como la banca, las telecomunicaciones, la energía o el transporte, entro otros. Por fin establecemos la misma realidad para la industria digital”.
Una de las primeras compañías afectadas que se ha pronunciado al respecto de la norma ha sido Apple. La firma de Cupertino, que se había mostrado en contra de la DMA en numerosas ocasiones, ha reiterado sus preocupaciones a través de un comunicado, que recoge Reuters, en el que cita que “algunas de las disposiciones dela DMA crearán vulnerabilidades innecesarias de privacidad y seguridad para nuestros usuarios, mientras que otras nos prohibirán cobrar por propiedad intelectual, un ámbito en el que invertimos mucho”.
Por su parte, desde Google han matizado que “si bien apoyamos muchas de las disposiciones de la DMA en torno a la elección del consumidor y la interoperabilidad, nos preocupa que alguna de estas reglas puedan frenar la innovación y la oferta para los europeos”.
Muchos de los analistas consultados por la agencia de noticias ponen de manifiesto que la normativa europea puede extenderse rápidamente por más geografías. “DMA ha llegado para quedarse y se reflejará rápidamente en varios países. La flexibilidad que tenían las grandes tecnológicas se verá limitada porque la ‘camisa de fuerza’ regulatoria se volverá más estricta a nivel mundial”, asevera Ioannis Kokkoris, profesor de derecho en la Universidad Queen Mary de Londres (Inglaterra).
Como contraprestación, dice Nicolas Petit, profesor de derecho de la competencia en el Instituto Universitario Europeo de Florencia (Italia), las nuevas reglas también podrán estimular un nuevo modelo de innovación de algunas empresas no tan grandes. “Creo que incentiva los modelos basados en suscripciones o de monetización a nivel de dispositivos. Es posible que suban los precios y que haya más integración de hardware en el futuro”.
