La Comisión Europea ha puesto en marcha una investigación antimonopolio sobre la competencia en el sector de (IoT) Internet de las Cosas para los productos y servicios relacionados con los consumidores en la Unión Europea.
La investigación se centrará en productos y servicios relacionados con los consumidores que estén conectados a una red y puedan controlarse a distancia, como es el caso de los dispositivos portátiles y asistentes virtuales. El conocimiento adquirido gracias a esta investigación contribuirá a la aplicación de la legislación en materia de competencia en este sector por parte de la Comisión.
En este sentido, la investigación sectorial abarcará productos como los dispositivos portátiles (por ejemplo, relojes inteligentes o monitores de actividad física) y los dispositivos de consumo conectados que se utilizan en el contexto del hogar inteligente, como frigoríficos, lavadoras, televisores, altavoces y sistemas de iluminación inteligentes. La investigación sectorial también recogerá información sobre los servicios disponibles a través de dispositivos inteligentes, como los servicios de música y vídeo en tiempo real y los asistentes virtuales empleados para acceder a ellos.
Y es que, a pesar de que el desarrollo del sector de Internet de las Cosas para los productos y los servicios relacionados con los consumidores en la Unión Europea está en una fase relativamente temprana, existen indicios de que determinadas prácticas empresariales pueden falsear estructuralmente la competencia.
Más en concreto, existen indicaciones relativas a las restricciones del acceso a los datos y la interoperabilidad, así como a determinadas formas de autofavorecimiento y prácticas relacionadas con el uso de las normas de dominio privado. Los ecosistemas de Internet de las Cosas suelen caracterizarse por fuertes efectos de red y economías de escala, lo que puede traducirse en la rápida aparición de ecosistemas digitales y guardianes de acceso dominantes, y pueden presentar riesgos de ventas a pérdida.
Finalmente, tras el análisis de los resultados, si la Comisión detectase problemas de competencia específicos, podría abrir nuevas investigaciones para garantizar el cumplimiento de las normas de la UE en materia de prácticas comerciales restrictivas y abuso de posiciones dominantes en el mercado (artículos 101 y 102 del Tratado de Funcionamiento de la Unión Europea, TFUE).
Al respecto, la vicepresidenta ejecutiva de la Comisión, Margrethe Vestager, responsable de la política de competencia, ha declarado que “se prevé que el Internet de las Cosas de consumo aumente considerablemente en los próximos años y se convierta en algo habitual en la vida cotidiana de los consumidores europeos. Imaginemos un frigorífico inteligente que le hace la lista de la compra que después envía usted a su dispositivo inteligente y, desde este, a una tienda la cual, a su vez, le lleva la compra hasta la puerta de su casa, que se abre automáticamente pronunciando una palabra. Las posibilidades parecen infinitas, pero el acceso a grandes cantidades de datos de usuario parece ser la clave del éxito en este sector, por lo que tenemos que cerciorarnos de que los agentes del mercado no utilicen su control sobre estos datos para falsear la competencia o cerrar de otro modo estos mercados a sus competidores. Esta investigación sectorial nos ayudará a comprender mejor la naturaleza y los probables efectos de los posibles problemas de competencia en este sector”.
