Las grandes tecnológicas hace tiempo que están en el radar de muchos países por su baja tributación pese a los enormes volúmenes de facturación gracias a una planificación fiscal agresiva. Para tratar de poner coto a esa situación España estudia, junto a otros países, crear un impuesto de carácter «temporal» a la economía digital que estaría pensado sobre todo para gigantes del sector como Amazon, Facebook, Apple o Google. Esta opción, que fuentes de Hacienda insistieron en que no está decidida ni definida y que se actuaría de forma conjunta con los socios comunitarios, se enmarca dentro de un debate más amplio que realiza la OCDE. De hecho, este organismo publicará en marzo el adelanto de un informe que presentará formalmente al G20 en abril y en el que incluirá una serie de recomendaciones sobre cómo gravar a este tipo de multinacionales digitales.
Sin embargo, algunos gobiernos no quieren esperar y están dispuestos a empezar a actuar antes. «Veremos algún tipo de forma de imposición de algunos estados como España», señaló ayer María José Garde, subdirectora general de Fiscalidad Internacional de la Agencia Tributaria. Una medida que sería de carácter «temporal» y en el «corto plazo» a la espera de que se llegue a un consenso a nivel internacional. Garde, que también es presidenta del Foro de Transparencia Global de la OCDE, admitió en una jornada de fiscalidad organizada por la Asociación para el Progreso en la Dirección (APD) y PwC, que en los gobiernos hay un «apetito fiscal» por gravar la economía digital de manera que estas multinacionales -en su mayoría estadounidenses- tributen por las actividades en el país donde están los consumidores. Esto es, en el territorio en el que realizan las ventas. Como solución en el largo plazo hay cierto consenso en crear la figura del establecimiento permanente virtual para estas compañías.
En cualquier caso, Garde insistió en que la posibilidad de aprobar una imposición a estas compañías depende del aval de la UE. Por ese motivo, las grandes economías comunitarias (Alemania, Francia, Italia y España) ya enviaron en septiembre una carta conjunta al presidente del Eurogrupo para solicitar una normativa europea que recoja los cambios necesarios para que la tributación de las empresas tecnológicas sea acorde a los volúmenes de ingresos que generan en cada territorio. Es decir, que tributen en función de la facturación obtenida en cada país y no según el beneficio (que puede reducirse mediante ajustes contables).
Para este propósito ayudará enormemente la información país por país del programa BEPS (lucha contra la erosión de bases imponibles) de la OCDE. Una medida que empezará a funcionar en junio y que obligará a las sociedades con una facturación superior a los 750 millones a desglosar los ingresos, activos, trabajadores e impuestos que pagan en cada Estado en el que operan.
Hay que tener en cuenta que el propio presidente del Gobierno, Mariano Rajoy, ya se mostró partidario de que este tipo de empresas paguen sus impuestos ahí donde facturen «sea Amazon o como se llamen». De hecho, estas grandes compañías están desde hace tiempo en el punto de mira de las agencias tributarias de diversos países así como de la Comisión Europea por sus prácticas de planificación fiscal agresiva que reduce notablemente su tributación.
Por otra parte, ayer el director general de la Agencia Tributaria, Santiago Menéndez, presumió de la cada vez mayor eficacia del organismo ante los tribunales. De hecho, en 2017 ganó el 71,8% de los litigios por delitos fiscales. Una cifra que supone un incremento de casi 20 puntos porcentuales respecto a cinco años antes. Y es que en 2012 solo el 54% de los fallos eran favorables al fisco.
