La Ley de Datos impulsada por Bruselas persigue estimular la innovación eliminando las barreras que obstruyen el acceso de los consumidores y las empresas a los datos. Estas son las nuevas reglas propuestas.
Bruselas da un paso adelante al perfilar nuevas reglas para el acceso y uso equitativo de datos industriales. El espaldarazo de la Eurocámara se produce después de la última sesión plenaria en la que se abordó cómo la Ley de Datos de la Unión Europea puede impulsar la innovación eliminando las barreras que obstruyen el acceso de los consumidores y las empresas a los datos. El proyecto de ley, en este sentido, debe contribuir al desarrollo de nuevos servicios, en particular en inteligencia artificial -que necesita enormes cantidades de datos para la creación de algoritmos-. También puede conllevar el abaratamiento de los servicios posventa y de las reparaciones de dispositivos conectados.
El volumen de datos generados por humanos y máquinas está aumentando exponencialmente y se está convirtiendo en un factor crítico para la innovación por parte de las empresas y las autoridades públicas, por ejemplo, para la configuración de las ciudades inteligentes. Tanto es así que algunos ya consideran que este tipo de datos se han convertido en “el nuevo petróleo”. En este sentido la Ley de Datos establece normas comunes para el intercambio de datos generados por el uso de productos conectados o servicios relacionados con el firme propósito de garantizar la equidad de los contratos de intercambio de datos.

Los eurodiputados han adoptado medidas para permitir a los usuarios acceder a los datos que generan, ya que, según la Comisión Europea, el 80% de los datos industriales recopilados nunca se utilizan. También quieren garantizar que los acuerdos contractuales estén en el centro de las relaciones entre empresas. Las compañías podrían decidir qué datos se pueden compartir, y el fabricante podrá optar por no dar acceso a ciertos datos. Cuando las empresas elaboren sus contratos de intercambio de datos, la ley reequilibrará el poder de negociación en favor de las pymes, protegiéndolas de las cláusulas contractuales abusivas impuestas por las empresas en una posición de negociación significativamente más fuerte.
El texto también define cómo los organismos del sector público pueden acceder y utilizar los datos en poder del sector privado que son necesarios en circunstancias excepcionales o emergencias, como inundaciones e incendios forestales. Siguiendo esta misma línea los eurodiputados también reforzaron las disposiciones para proteger los secretos comerciales y evitar una situación en la que los competidores utilicen un mayor acceso a los datos para servicios o dispositivos de retroingeniería. Asimismo, han impuesto condiciones más estrictas para las solicitudes de datos entre empresas y gobiernos.
Por último, la Ley de Datos facilitará el cambio entre proveedores de servicios en la nube y otros servicios de tratamiento de datos, e introducirá salvaguardias contra la transferencia internacional ilegal de datos por parte de los proveedores de servicios en la nube. “La Ley de Datos supone un cambio total en las reglas de juego que proporcionará acceso a una cantidad casi infinita de datos industriales de alta calidad.
