Bruselas aprueba la iniciativa del Gobierno que propone que el nuevo Reglamento Europeo de Inteligencia Artificial se ensaye en España a partir de octubre, año y medio antes de su entrada en vigor.
El Gobierno de España y la Comisión Europea han anunciado oficialmente que España será el primer país que implemente el Reglamento de Inteligencia Artificial de la Unión Europea (UE), que se prevé que entre en vigor en enero de 2024. En este sentido cabe mencionar que esta no es la primera medida impulsada por el Ejecutivo de Pedro Sánchez para contrarrestar los posibles efectos adversos de los sistemas de IA, como la transparencia de los algoritmos laborales prevista en la ‘ley rider’ o la Agencia de Supervisión de Algoritmos que el gobierno central planea constituir a finales de este año. Así, a partir del próximo mes de octubre, España se convertirá en el país piloto de los Veintisiete, poniendo en marcha un sandbox (cajón de arena, en inglés) normativo para testar el nuevo reglamento comunitario.
Se trata del primer paquete de normas a gran escala para que la inteligencia artificial deje de ser una tecnología desregulada. Además, otro de los objetivos de este proyecto piloto que se regulará en el interior de las fronteras del país es que no pille a los países desprevenidos. Aunque el reglamento no finalizará su proceso en Europa y entrará en vigor hasta enero de 2024, la intención es “prepararnos para evitar posibles problemas cuando se aplique, pensando sobre todo en las pymes”. Así lo ha asegurado Carme Artigas, la secretaria de Estado de Digitalización e Inteligencia Artificial, en un encuentro con la prensa en el que ha añadido que la intención es evitar “una moratoria a dos años, porque supondría dos años más de IA sin cortapisas ni nada que controle sus efectos negativos”.
Con la aplicación del sandbox, el reglamento podrá traducirse, a efectos prácticos, en herramientas, manuales de uso de fácil implantación o guías metodológicas, entre otras cosas. Además, la secretaria de Estado ha dejado claro que la intención no es “influir en los procesos de elaboración del reglamento”, sino ponerlo en práctica para ver sus posibles fallos y poder solucionarlos a tiempo para la fecha de implantación. Además, ha asegurado que “el piloto es flexible. Si durante la negociación hay cambios en el reglamento, tenemos la flexibilidad suficiente para implementarlos”.
El objetivo del Gobierno es aunar en este proyecto piloto al propio Ejecutivo, empresas, centros de investigación y pymes para que se determine si la regulación es adecuada y asumible por todos los estratos sociales y económicos. Desde la Secretaría se ha señalado que se realizará una “invitación pública a las empresas” y posteriormente se seleccionará, priorizando ámbitos sectoriales y de relaciones laborales, las que participarán en el proyecto piloto.
Entre las medidas que prepara Bruselas se encuentra la prohibición de los criticados sistemas de reconocimiento facial cuando se empleen en espacios públicos, o aquellos que pueden modificar el comportamiento humano. El reglamento creará varios niveles de riesgo para los sistemas de IA. Los dos citados serán considerados de “alto riesgo” y “estarán sujetos a estrictas obligaciones antes de que puedan comercializarse”.
España invertirá 4,3 millones de euros de los fondos de recuperación para sufragar los gastos del proyecto piloto. La coordinación correrá a cargo de la SEDIA, organismo dependiente del Ministerio de Asuntos Económicos. Mencionar además que, aunque el Reglamento Europeo sobre IA que se está perfilando en Bruselas no entraría en funcionamiento hasta el 2024, el Gobierno espera que la Comisión y el Parlamento hayan acordado un texto prácticamente definitivo para octubre, momento en el que empezará a ensayarse en España.
