El Consejo de Gobierno de Aragón ha aprobado el proyecto de ley de medidas para la implantación y el desarrollo de las tecnologías en la nube en la Comunidad, que será enviado a las Cortes de Aragón para su tramitación parlamentaria. La futura ley será pionera en Europa y servirá de palanca para acelerar la transformación digital del territorio y promover un ecosistema empresarial innovador alrededor de estas tecnologías, de gran capacidad transformadora y más sostenibles.
Partiendo del potencial y las ventajas que ofrece el Cloud –prestación de servicios tecnológicos a través de internet sin necesidad de infraestructura física, pago por uso y escalabilidad-, la norma persigue el impulso de estas tecnologías en el territorio aragonés, así como la generación y actualización del talento y las nuevas habilidades dentro del sector de las tecnologías de la información y las telecomunicaciones de Aragón.
Con esta norma, desarrollada por la entidad pública Aragonesa de Servicios Telemáticos, dependiente del Departamento de Ciencia, Universidad y Sociedad del Conocimiento, Aragón quiere prepararse ante el reto tecnológico, creando un ecosistema de negocio digital alrededor de las tecnologías en la nube, de bajo impacto medioambiental y democratizador con la innovación.
La ley se estructura en seis capítulos y 39 artículos, encaminados a alcanzar la mayor implantación y desarrollo del Cloud en Aragón, partiendo de la administración pública, pero facilitando también su adopción por otros agentes.

La norma se enmarca en la estrategia de digitalización de la administración pública. Actualmente, los servicios públicos digitales de la administración autonómica se prestan mayoritariamente desde centros de procesos de datos privados pero, para ganar en competitividad y reducir también la huella de carbono, se persigue avanzar hacia un sistema de nube híbrida.
De tal forma, que aquellos datos más sensibles y los servicios esenciales continuarán en el Cloud privado y se decidirá, con todas las garantías, en qué casos el Cloud público es más adecuado para la prestación de los servicios desde la perspectiva de eficiencia en el uso de recursos, la sostenibilidad o la innovación.
La nueva normativa regula cómo se hará ese paso, en qué condiciones, con qué requisitos y reforzará la confianza digital con una carta de garantías para asegurar la privacidad de los datos en todo momento y que recogerá los compromisos de protección y tutela que el Gobierno adquiere sobre ellos.
En este sentido, la ley prevé un plazo de seis meses para definir por parte de AST la Política Cloud del Gobierno, que fijará la tipología de servicios para los que el uso de las tecnologías Cloud esté indicado y las condiciones para su utilización, salvaguardando en todo momento las máximas garantías de seguridad y continuidad de los servicios y sistemas de información.
Toda la coordinación, seguimiento, evaluación, impulso y comunicación de las acciones referentes a las tecnologías en la nube en el sector público autonómico corresponderá a una nueva Comisión para las Tecnologías Cloud. Además, para expandir el uso más allá de la administración pública, especialmente en el tejido empresarial y garantizar el máximo nivel de fiabilidad, AST implantará también un certificado de homologación, que funcionará como un distintivo de calidad y seguridad.
Aquellos proveedores que obtengan la llamada Solución Cloud Certificada de Aragón figurarán en un registro público, de tal forma que los potenciales usuarios de servicios Cloud puedan disponer de una lista de máxima confianza de entidades prestadoras.
