La ministra de Hacienda María Jesús Montero ha dado a conocer hoy la aprobación por parte del Consejo de Ministros del anteproyecto de ley del impuesto sobre servicios digitales, que se enmarca dentro de los presupuestos generales del Estado del Ejecutivo de Sánchez, pendientes aún del visto bueno de la Comisión Europea y de la aprobación en el Parlamento español. La nueva tasa, prevista ya por el anterior Gobierno popular pues es un impuesto propuesto en la Unión Europea, gravará un 3% los ingresos generados por la publicidad online, la intermediación en línea y la venta de datos recopilada de la información que proporcionan los usuarios, lo que permitirá una recaudación por parte de Hacienda de 1.200 millones de euros, según las estimaciones realizadas por la propia Agencia Tributaria y confirmadas por la propia Montero.
“España es el primer país que pone en marcha este impuesto propuesto por la UE”, ha recordado la ministra, precisando que afecta a las empresas que se dedican a las actividades antes mencionadas y que “facturan más de 750 millones de euros en nuestro país aunque solo generen 3 millones de euros; es decir, las pymes no van a verse afectadas por esta tasa”.
Montero ha señalado que el objetivo de este anteproyecto, así como de otros dos nuevos aprobados también hoy por el Consejo de Ministros como el Anteproyecto de ley de lucha contra el fraude y el Anteproyecto de ley del impuesto de transacciones financieras, “sientan las bases para crear una sociedad más justa al tiempo que permiten cumplir los compromisos presupuestarios realizados con Bruselas”. “Como señala el propio presidente no podemos aspirar a un estado de bienestar de primera con unos ingresos de tercera”, según Montero, quien añadió que “no es posible avanzar en justicia social si no se avanza en justicia fiscal”.
Control de las criptomonedas
Dentro del anteproyecto de lucha contra el fraude figura una medida novedosa: un mayor control tributario de las criptomonedas. Será la propia Agencia Tributaria quien realice esta mayor labor de control sobre las personas o empresas que lleven a cabo operaciones tanto en España como en el exterior.
Asimismo, y “dado que el avance de la tecnología permite fórmulas cada vez más sofisticadas como es el uso de software que permite la ocultación de cuentas”, según Montero, se prohibirá la producción, tenencia y comercialización de este software de doble uso y se garantizará la trazabilidad e inviolabilidad de los registros económicos de las empresas. “Los proveedores de este tipo de software ilegal serán sancionados hasta con 150.000 euros”.
Este anteproyecto incorpora además una actualización del contepto de ‘paraíso fiscal’. “El objetivo es que las multinacionales tributen en los países que operen y así evitar el traslado de los beneficios de estas empresas a países con baja tributación”, aseveró la ministra, en clara relación a compañías como Apple o Google y tantas otras multinacionales americanas que realizan estas prácticas legales pero polémicas pues apenas contribuyen a la economía nacional de los países donde tienen presencia. Con este anteproyecto de lucha contra el fraude el Gobierno espera recaudar unos 828 millones de euros.
Para ello, según la ministra, la Agencia Tributaria, que es la que se encargará de realizar un control más exhaustivo de las áreas comentadas, contará con más recursos humanos y se mejorará el sistema informático del organismo con una nueva inversión de 33 millones de euros.
