La sociedad lleva inmersa en una transformación digital desde hace unos años y esta evolución está modificando su relación con la Administración y, como consecuencia, el trabajo en los Archivos, debido a un nuevo protagonista: el documento electrónico. El archivo electrónico forma parte de esta metamorfosis digital y la gestión del documento electrónico supone un gran cambio de paradigma tanto para el Archivo como para su profesional.
A día de hoy, se está dotando a la Administración de herramientas que permiten llevar a cabo un registro y una tramitación electrónica de sus procesos documentales. Todo esto con criterios de gestión documental, y con nuevas herramientas, metodologías y conceptos, por ejemplo, OAIS, SIP, AIP, METS, PREMIS, firma electrónica, ENI, etc. Es la unión de los conceptos y las herramientas tradicionales (descripción, cuadro de clasificación, valoración documental, etc.) con lo nuevo lo que marca el camino del archivero y de la profesión.
En España, tras una normativa y legislación difusa y poco desarrollada, la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común (LPAC) ha establecido la obligatoriedad de toda Administración Pública de mantener y gestionar un archivo electrónico único. La ley, en su artículo 17 establece:
El archivo electrónico único es el conjunto de expedientes electrónicos compuesto por documentos, también electrónicos, que corresponden a procedimientos finalizados. Además, los expedientes y documentos deberán cumplir una serie de condiciones establecidas, entre otras, en las NTI (Normas Técnicas de Interoperabilidad) de expediente y NTI de documento.
Los documentos electrónicos deberán conservarse en un formato que permita garantizar la autenticidad, la integridad y la conservación del documento. Por último, dice que los medios o soportes en que se almacenen documentos, deberán contar con medidas de seguridad, de acuerdo con lo previsto en el ENS (Esquema Nacional de Seguridad), garantizando así la integridad, la autenticidad, la confidencialidad, la calidad, la protección y la conservación de los documentos almacenados.
El Real Decreto-ley 11/2018, de 31 de agosto, por el que se modifica la Ley 39/2015, realizó una ampliación del plazo para que las diferentes instituciones del sector público implantaran sus correspondientes archivos electrónicos únicos. Ese plazo fue el pasado 2 de octubre de 2020, pero ante la dificultad de concluir estos procesos de adaptación necesarios, se ha ampliado, de nuevo, hasta el 2 de abril de 2021, fecha a partir de la cual producirán efectos las previsiones sobre tales materias. Esto queda plasmado en el Real Decreto-ley 28/2020, de 22 de septiembre, de trabajo a distancia, que modifica la Ley 39/2015: «Las previsiones relativas al registro electrónico de apoderamientos, registro electrónico, registro de empleados públicos habilitados, punto de acceso general electrónico de la Administración y archivo único electrónico producirán efectos a partir del día 2 de abril de 2021».
