Este paquete de medidas consta una Estrategia de Finanzas Digitales, una Estrategia de Pagos Minoristas (retail), propuestas legislativas para un marco regulador de la UE en materia de criptoactivos y propuestas para un marco regulador de la UE sobre resiliencia operativa digital.
Estrategia de Finanzas
Digitales
Su objetivo es hacer que los servicios financieros europeos sean más favorables
a la digitalización y estimular la innovación responsable y la competencia
entre los proveedores de servicios financieros de la UE. La Estrategia reducirá
la fragmentación del mercado único digital, de modo que los consumidores puedan
tener acceso a productos financieros transfronterizos y las empresas emergentes
de tecnología financiera se expandan y crezcan, y garantizará que las normas de
la UE en materia de servicios financieros se adapten a la era digital, a
aplicaciones tales como la inteligencia artificial y la cadena de bloques. La
gestión de datos también forma parte del núcleo de la estrategia de hoy.
En consonancia con la estrategia en materia de datos de la Comisión, más amplia, el objetivo de las medidas es promover el intercambio de datos y las finanzas abiertas, manteniendo al mismo tiempo las estrictas normas de la UE en materia de privacidad y protección de datos. Por último, tiene por objeto garantizar la igualdad de condiciones entre los proveedores de servicios financieros, ya sean bancos tradicionales o empresas tecnológicas: misma actividad, mismos riesgos, mismas normas.
Estrategia de Pagos Minoristas
Esta estrategia tiene como objetivo ofrecer servicios de pago seguros, rápidos
y fiables a las empresas y los ciudadanos europeos, facilitará a los consumidores
el pago en las tiendas y hará que las transacciones de comercio electrónico
sean seguras y prácticas. Su objetivo es lograr un sistema de pagos minoristas
plenamente integrado en la Unión, con formas de pago transfronterizo
instantáneo. De esta forma se facilitarán los pagos en euros entre la UE y
otros territorios y se fomentará la aparición de soluciones de pago paneuropeas
y locales.
Propuestas en materia de
criptoactivos
Por primera vez, la Comisión ha propuesto nueva legislación en materia de
criptoactivos (una representación digital de valores o derechos que pueden
almacenarse y negociarse electrónicamente), con las que espera impulsar la
innovación, preservando al mismo tiempo la estabilidad financiera y protegiendo
a los inversores de los riesgos.
El reglamento en el que está trabajando permitirá a los operadores autorizados en un Estado miembro prestar sus servicios en toda la UE mediante un ‘régimen de pasaporte’). “Las salvaguardias incluyen requisitos de capital, custodia de activos, un procedimiento obligatorio de reclamación a disposición de los inversores y derechos del inversor frente al emisor. Los emisores de criptoactivos respaldados por activos significativos (las denominadas ‘criptomonedas estables’ de nivel mundial) estarían sujetos a requisitos más estrictos (por ejemplo, en términos de capital, derechos de los inversores y supervisión)”, explica el organismo en un comunicado.
La Comisión también ha propuesto un régimen piloto para las infraestructuras de mercado que deseen intentar negociar y liquidar operaciones de instrumentos financieros en forma de criptoactivos. Se trataría de probar en un entorno controlado excepciones temporales a las normas existentes para que los reguladores puedan adquirir experiencia en el uso de la tecnología de registro distribuido en las infraestructuras de mercado, garantizando al mismo tiempo que puedan hacer frente a los riesgos relativos a la protección de los inversores, la integridad del mercado y la estabilidad financiera. Lo que se pretende es permitir que las empresas experimenten y aprendan más sobre cómo se aplican las normas vigentes en la práctica.
Propuestas legislativas sobre
la resiliencia operativa digital
Según la comisión, las empresas tecnológicas tienen cada vez más peso en el ámbito
financiero, tanto como proveedores de tecnologías de la información a las
empresas financieras como en calidad de proveedores de servicios financieros.
La Ley de Resiliencia Operativa Digital aspira a garantizar que todos los
participantes en el sistema financiero cuenten con las salvaguardias necesarias
para paliar ciberataques y otros riesgos.
En su comunicado, dice que la legislación “exigirá a todas las empresas que se aseguren de que pueden resistir a cualquier tipo de perturbaciones y amenazas relacionadas con las tecnologías de la información y la comunicación (TIC)” Y, en línea con eso, también ha introducido un marco de supervisión para los proveedores de TIC, por ejemplo los proveedores de servicios de computación en la nube.
