En el anterior sentido, habrá que tener en cuenta el contenido de la Directiva (UE) 2015/849 relativa a la prevención de la utilización del sistema financiero para el blanqueo de capitales o la financiación del terrorismo, y la Directiva (UE) 2019/713, de 17 de abril de 2019, sobre la lucha contra el fraude y la falsificación de medios de pago distintos del efectivo.
En lo que respecta a los usos sociales de las criptomonedas, si nos centramos en las actividades lícitas, ya casi nadie es ajeno a que son aceptadas por comercios como forma de pago de productos y servicios en sustitución de monedas de curso legal, y en otras muchas ocasiones, son utilizados como activos a través de los cuales especular con su compra y venta en exchanges. Si por el contrario nos centramos en actividades ilícitas asociadas a las monedas virtuales, no nos resultará difícil localizar infinidad de supuestos de fraude en lo que los beneficios ocultan o directamente se obtienen en bitcoins.

A modo de ejemplo, en los últimos meses ha sido muy frecuente el fraude consistente en la remisión masiva por parte del delincuente de un correo electrónico solicitando a sus víctimas una recompensa en bitcoins a cambio de no revelar contenido íntimo que supuestamente había obtenido hackeando su cuenta de correo electrónico, webcam o el propio dispositivo. Lo cierto, es que a través de ésta y otras tantas conductas más o menos sofisticadas, se habrán podido adquirir fraudulentamente grandes cantidades de monedas virtuales que de cambiarse por monedas de curso legal o fiat alcanzarían cifras nada desdeñables.
Esta circunstancia ha sido tenida en cuenta por el legislador europeo quien, en defensa de la estabilidad del sistema financiero, ha aprobado las dos directivas antes citadas. La Directiva (UE) 2015/849 relativa a la prevención de la utilización del sistema financiero para el blanqueo de capitales o la financiación del terrorismo incluye como sujetos obligados a cumplir con las medidas de diligencia debida establecidas por las normas para la Prevención de Blanqueo de Capitales, a los proveedores de servicios de cambio de monedas virtuales por monedas fiduciarias (Exchanges), quienes, entre otras obligaciones deberán identificar correctamente a sus clientes, así como el origen de los fondos que reciben.
Imaginemos por un momento el cuestionario KYC (know your customer) de blanqueo de capitales que pasaría un usuario cualquiera de un Exchange.

¿Podrá el SEPBLAC considerar que se trata de una operación de alto riesgo de blanqueo de capitales o exigir alguna información adicional al respecto que acredite la condición de minero del usuario?
El legislador europeo, asume ya que no va a ser tarea fácil controlar el uso de las monedas virtuales, y en el considerando 9 de la nueva Directiva 713/2019 antes citada indica que la inclusión de los exchanges como sujetos obligados no resolverá totalmente la cuestión, ya que además de las dificultades que podrán existir en el cumplimiento de las obligaciones de diligencia debida, los usuarios pueden llevar a cabo transacciones al margen de tales proveedores de servicios. Para resolver esta cuestión señala dos posibles soluciones, 1) que las Unidades de Inteligencia Financiera (UIF) nacionales puedan obtener información que les permitan asociar las direcciones de las monedas virtuales a la identidad del propietario de la moneda virtual y 2) la posibilidad de que los usuarios efectúen, con carácter voluntario, una autodeclaración a las autoridades designadas.
Con los debidos respetos, si el formulario de blanqueo para los usuarios de los Exchanges podía parecer complicado, la idea de identificar a los titulares de todas y cada una de las addresses, se me antoja absolutamente imposible.
Pasando ya al régimen sancionador de carácter penal la Directiva 713/2019, de 17 de abril de 2019, sobre la lucha contra el fraude y la falsificación de medios de pago distintos del efectivo impone a los Estados Miembros la obligación de incluir en sus ordenamientos jurídicos antes del 31 de mayo de 2021, algunas conductas delictivas asociadas a monedas virtuales, incluyendo el que podría ser el futuro delito de blanqueo de criptomendas que describe de la siguiente forma (art. 4 c):
“la posesión, para su utilización fraudulenta, de un instrumento de pago inmaterial distinto del efectivo que haya sido objeto de obtención ilícita, falsificación o alteración, al menos si el origen ilícito del instrumento se conocía en el momento de su posesión”
De una lectura rápida podemos llegar a la conclusión de que estarían incurriendo en este delito todas aquellas personas que de una manera o de otra posean criptomonedas a sabiendas de que su origen es una actividad ilícita. Ahora bien, volvemos a hacernos la misma pregunta, ¿cómo se va a conocer por parte del Juez el origen de las criptomonedas que no provengan de exchanges obligados a identificar a sus usuarios? Y si no se puede conocer este origen, ¿se presumirá ilícita la tenencia de criptomonedas en wallets que no sean facilitados por un tercero?
Si esto fuera así, se estaría cercenando las infinitas posibilidades de las criptomonedas y centralizando una tecnología que nació descentralizada con el objetivo de garantizar la estabilidad del sistema financiero.
