El Consejo Europeo ha anunciado que los representantes de los Estados miembro han alcanzado una posición común sobre los requisitos de seguridad de los productos digitales. Esta es su propuesta.
La Unión Europea (UE) continúa perfilando la Ley de Ciberresiliencia (CRA, por sus siglas en inglés). De hecho, la última sesión celebrada por el Consejo Europeo concluyó en consenso. Así, con vistas a garantizar que los productos con componentes digitales, como cámaras domésticas conectadas, frigoríficos inteligentes, televisores y juguetes, sean seguros antes de entrar en el mercado, los representantes de los Estados miembros (Coreper) han alcanzado una posición común sobre la propuesta legislativa relativa a los requisitos horizontales de ciberseguridad para este tipo de artículos.
Una conformidad que no dudaba en celebrar Carme Artigas, secretaria de Estado de Digitalización e Inteligencia Artificial. “Este acuerdo nos permite avanzar en el compromiso de la UE hacia un mercado digital único y seguro. El IoT y otros objetos conectados tienen que venir con un nivel básico de ciberseguridad cuando se vendan en la UE, garantizando que las empresas y los consumidores estén protegidos eficazmente contra las ciberamenazas. Este es un hito importante para la presidencia española, y esperamos adelantar al máximo las negociaciones con el Parlamento”, aseveraba.
El proyecto de reglamento introduce requisitos obligatorios de ciberseguridad para el diseño, el desarrollo, la producción y la comercialización de productos de hardware y software con el fin de evitar el solapamiento de las exigencias derivadas de diferentes actos legislativos de los Estados miembros de la UE. En este sentido, el conjunto de reglas propuesto se aplicará a todos los productos que estén conectados directa o indirectamente a otro dispositivo o red. Hay algunas excepciones para los productos cuyos requisitos de ciberseguridad ya están establecidos en normas comunitarias vigentes, por ejemplo los dispositivos médicos, la aviación o los automóviles.
De esta manera la propuesta pretende colmar las lagunas, aclarar los vínculos y hacer más coherente la legislación vigente en materia de ciberseguridad, garantizando que los productos con componentes digitales, por ejemplo los productos del IoT, sean seguros a lo largo de toda la cadena de suministro y durante todo su ciclo de vida. Por último, el reglamento también permite a los consumidores tener en cuenta la ciberseguridad a la hora de seleccionar y utilizar productos que contienen elementos digitales, ofreciendo a los usuarios la oportunidad de elegir con conocimiento de causa productos de hardware y software con las características de ciberseguridad adecuadas.
La posición común del Consejo mantiene la orientación general de la propuesta de la Comisión. Así conserva las normas para reequilibrar la responsabilidad del cumplimiento hacia los fabricantes, que deben garantizar la conformidad con los requisitos de seguridad de los productos con elementos digitales que se comercializan en la UE, incluidas obligaciones como la evaluación del riesgo de ciberseguridad, la declaración de conformidad y la cooperación con las autoridades competentes. También lo hace con los requisitos esenciales para los procesos de gestión de vulnerabilidades para que los fabricantes garanticen la ciberseguridad de los productos digitales, y con las obligaciones para los operadores económicos, como importadores o distribuidores. En relación con estos procesos, mantiene medidas para mejorar la transparencia sobre la seguridad de los productos de hardware y software para consumidores y usuarios empresariales, e impulsa un marco de vigilancia del mercado para hacer cumplir estas normas.
Sin embargo, el texto del Consejo modifica varias partes de la propuesta de la Comisión, en particular, los siguientes aspectos: el ámbito de aplicación de la legislación propuesta, incluidas las categorías específicas de productos que deben cumplir los requisitos del reglamento; las obligaciones de notificación de vulnerabilidades o incidentes activamente explotados a las autoridades nacionales competentes («equipos de respuesta a incidentes de seguridad informática» – CSIRT) en lugar de a la agencia de la UE para la ciberseguridad (ENISA), estableciendo esta última una plataforma única de notificación; elementos para la determinación de la vida útil prevista de los productos por parte de los fabricantes; y, por último, medidas de apoyo a las pequeñas empresas y microempresas una declaración de conformidad simplificada.
El acuerdo alcanzado sobre la posición común del Consejo («mandato de negociación») permitirá a la Presidencia española entablar negociaciones con el Parlamento Europeo («diálogos a tres bandas») sobre la versión final de la legislación propuesta.
